These terms govern your use of the ArjunaFx software, the customer portal and everything else we provide at arjunafx.trade. By registering an account or running our Expert Advisor, you agree to them. Read the risk warning below before you go any further.
These Terms and Conditions ("Terms") are an agreement between you and Agyaat Solutions ("Arjuna", "we", "us"), a business established in India, operator of the ArjunaFx Expert Advisor and the Arjuna dashboard and customer portal (together, the "Service").
By creating an account, installing the Expert Advisor, or using any part of the Service, you confirm that you have read, understood and accepted these Terms and our Privacy Policy. If you do not accept them, do not use the Service.
You may use the Service only if you are at least 18 years old, have the legal capacity to enter into a binding contract, and are not barred from using the Service under the laws of your country. You are responsible for confirming that automated trading and the use of Expert Advisors are lawful where you live and permitted by your broker.
We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and run the ArjunaFx Expert Advisor on the MetaTrader accounts we have licensed for you, and to access the customer portal for those accounts. We retain all intellectual property rights in the software, the dashboard, the strategy logic and everything else we supply.
The Expert Advisor runs on your MetaTrader terminal, on your machine or your VPS. It reports telemetry to us and polls for commands you or we issue through the dashboard, such as pause, resume, change side, close a position or change a parameter.
Because the software runs on your terminal and trades through your broker, execution depends on your platform, your internet connection, your VPS and your broker. We do not hold your funds, we hold no broker credentials, and we cannot deposit, withdraw or transfer money on your behalf.
The Service is currently provided without a subscription fee; accounts are onboarded and licensed manually by us. If we introduce fees, we will publish the pricing and give you notice before it applies to your account, and you will be free to stop using the Service instead of accepting them.
Any costs you incur with third parties — broker spreads, commissions, swaps, slippage, VPS hosting, data feeds and taxes — are yours and are not charged or controlled by us.
Each trading account carries a licence switch. We may suspend it, which stops the bots on that account from trading, or terminate your access entirely, if:
You may stop using the Service at any time by removing the Expert Advisor from your charts and asking us to close your account. Suspension or termination does not close your open positions — managing or closing them remains your responsibility, and you should do so through your broker or terminal.
Nothing in the Service is investment, financial, legal or tax advice, and nothing in it is a recommendation to buy or sell any instrument. We are not a broker, not an investment adviser, and not a portfolio manager. We do not manage your money and we do not exercise discretion over your account beyond executing the settings and commands you choose.
Seek independent, licensed advice if you are unsure whether automated trading is appropriate for your circumstances.
MetaTrader, your broker, your VPS provider and any signal or data source are independent third parties. We are not affiliated with, and do not act as agent for, any of them unless we say so in writing. Your relationship with your broker is governed by their agreement with you, and any dispute about execution, spreads, slippage, requotes, margin calls or withdrawals is between you and them.
We aim to keep the Service running but we do not promise uninterrupted availability. Maintenance, upgrades, provider outages, network failures, platform changes and events outside our reasonable control can all interrupt it. Commands issued during an outage may be delayed or not delivered, and telemetry may be incomplete. Do not rely on the dashboard as your only view of your account — your broker terminal is the authoritative record.
We may change, add or withdraw features. Where a change materially reduces what the Service does for you, we will give reasonable notice.
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we exclude all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be error-free, that defects will be corrected, or that it will produce any particular trading outcome.
To the fullest extent permitted by law, we are not liable for trading losses, lost profits, lost opportunity, loss of data, or any indirect, incidental, special or consequential damages arising out of or connected with the Service — including losses caused by execution failures, latency, downtime, incorrect settings, broker behaviour or your own decisions.
Our total aggregate liability to you for all claims arising in any 12-month period is limited to the greater of the fees you actually paid us for the Service in that period and INR 10,000.
Nothing in these Terms excludes liability for fraud, for death or personal injury caused by our negligence, or for anything else that cannot lawfully be excluded.
You agree to indemnify us against claims, losses and reasonable costs arising from your breach of these Terms, your misuse of the Service, or your breach of any law or of your broker’s terms.
Our handling of personal data is described in the Privacy Policy, which forms part of these Terms. It explains what the Expert Advisor reports to us, how long we keep it and the rights you have over it.
We may update these Terms as the Service and the law change. The effective date at the top reflects the current version. For material changes we will notify you by email or through the portal before they take effect. Continuing to use the Service after that date means you accept the updated Terms.
These Terms are governed by the laws of India. The courts at Maharashtra, India have exclusive jurisdiction over any dispute arising out of them, except that we may seek injunctive relief in any competent court to protect our intellectual property.
